Under certain circumstances, RWCS will handle so-called white-collar criminal defense matters for individuals and companies. RWCS has represented many high-profile and ordinary citizens, as well as companies and/or their officers, managers, etc., in criminal prosecutions or at the earlier stages of criminal proceedings.
Most criminal investigations and prosecutions are very sensitive and therefore RWCS is extremely circumspect about discussing its involvement in such matters. Accordingly, we won’t list current or recent representations in criminal matters here, but the following information about our experience and capabilities may be helpful.
Two RWCS partners have been United States Attorneys for the Western District of Oklahoma (appointed by the President): Pat Ryan (1995-1999) and Dan Webber (1999-2001). As U.S. Attorney, Pat Ryan was personally involved in prosecuting the Oklahoma City bombing trials, including obtaining the death penalty for Timothy McVeigh. Later, as defense attorneys, Pat Ryan and Dan Webber obtained a complete acquittal on 57 counts for Bill Bartmann in a high-profile U.S. Dept. of Justice prosecution.
In addition, Keith Klein and Grant Lucky have substantial criminal trial experience. Notably, Klein and Mark Coldiron obtained an outright acquittal in federal court in a major environmental criminal case. Klein, Coldiron, and other RWCS attorneys including Don Shandy have also participated in defense of numerous criminal investigations and subsequent threatened or actual enforcement action.
The capability to handle any potential criminal enforcement action strongly complements RWCS’s litigation, energy, and environmental law practice. Sometimes, when a company or individual is alleged to have violated environmental, health, or safety laws or regulations, there is also the risk of parallel criminal enforcement. When that happens, RWCS knows how to address the situation.
